General Terms and Conditions
of the Online Store matchavia.sk
I. Introductory Provisions and Definitions
1.1 These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the legal relationships between:

(hereinafter referred to as the “Seller”)
and any person who is a Buyer of goods or services offered by the Seller on the Seller’s Website, acting as a consumer within the meaning of applicable Slovak legislation, in particular:
- Act No. 108/2024 Coll. on Consumer Protection
- Act No. 22/2004 Coll. on Electronic Commerce
- Act No. 40/1964 Coll. Civil Code
as amended.

1.2 These GTC regulate legal relationships between the Seller and Buyers who are consumers.
1.3 The term “Online Store” is identical to “Electronic Store” and “Website”.
1.4 The “Buyer” is any person (natural or legal) who submits an order via the electronic order form on the Seller’s Website or through other remote communication means.
1.5 A “Consumer” is a Buyer who is a natural person and who does not act within the scope of their business activity when concluding a purchase contract.
1.6 Legal relationships with Buyers who are legal entities or entrepreneurs are governed by the Commercial Code (Act No. 513/1991 Coll.).
1.7 A “distance contract” means a contract concluded exclusively through remote communication without the simultaneous physical presence of the Seller and the Consumer.
1.8 A “Purchase Contract” includes both contracts for goods and service provision.
1.9 “Products” (or “Goods”) are goods or services offered for sale on the Seller’s Website.
1.10 The Seller operates the website under the domain matchavia.sk.

1.12 Buyers may also submit complaints directly to the Seller (preferably via email).
II. Order of Products – Conclusion of Purchase Contract
2.1 The Buyer submits a proposal to conclude a purchase contract by placing an order.
2.2 The contract is concluded upon delivery of order confirmation to the Buyer.
2.3 The contract is concluded for a fixed period and terminates upon fulfillment of obligations.
2.3.1 It may also terminate by agreement or withdrawal.
2.4 Placing an order creates an obligation to pay.
2.5 The Seller may refuse an order if:
- the Buyer failed to accept goods in the past
- the order appears unreliable
- goods are unavailable
III. General Information About Goods
3.1 The Seller offers goods via the Website.
3.2 Food products (e.g. matcha) may have specific conditions (storage, shelf life, usage).
3.3 These conditions are provided in product descriptions or packaging.
3.4 By ordering, the Buyer confirms awareness of these conditions.
3.5 Certain goods are delivered in sealed protective packaging.
3.6 The Buyer must inspect goods upon delivery.
IV. Purchase Price and Payment Terms
4.1 Prices are listed per product and valid at the time of order.
4.2 Currency: Euro.
4.3 Prices include all taxes.
4.3.1 Delivery costs are not included.
V. Payment Methods
5.1 Available methods:
- Card payment via payment gateway
- Bank transfer
- Apple Pay / Google Pay
5.2 For bank transfers, the order is confirmed after payment is received.
VI. Delivery of Products
6.1 Delivery within max. 30 days after contract conclusion and payment.
Typical dispatch time: 3 working days after payment.
6.1.2 If delivery is not possible, the Buyer may withdraw.
6.2 Delivery address = address provided by Buyer.
6.3 Delivery via Seller or third parties.
6.4 Delivery is completed upon receipt.
6.5 Partial deliveries are allowed without extra cost (if agreed).
6.6 Seller provides goods in agreed quantity and quality.
VII. Acceptance of Goods
7.1 Risk transfers upon receipt.
7.2 Buyer must check goods upon delivery.
7.3 Ownership transfers upon receipt.
7.4 Seller is entitled to payment.
VIII. Shipping
8.1 Delivery methods:
- Packeta
8.2 Prices:
- Z-BOX: €2.30
- Courier: €3.60
8.2 Free shipping above €50.
8.3 Prices may change.
IX. Withdrawal Without Reason
9.1 The withdrawal period starts upon receipt of goods.
9.1.2–9.1.3 Special rules apply if information obligations were not fulfilled.
9.1.5 No withdrawal right applies for:
- custom-made goods
- perishable goods
- opened hygienic packaging
9.2 Goods must be returned within 14 days.
9.3 Withdrawal must be sent within the deadline.
9.4 All related contracts are cancelled.
9.5 Parties must return all performances.
9.6 Withdrawal form available on website.
9.7 Consumer bears return costs (unless stated otherwise).
9.8 Seller refunds within 14 days.
9.9 Extra delivery costs are not refunded.
9.10 Cash-on-delivery returns will not be accepted.
X. Alternative Dispute Resolution
10.1 Consumers may request dispute resolution via:
- Slovak Trade Inspection Authority
- Other authorized ADR entities

XI. Intellectual Property Protection
11.2 Without consent, it is prohibited to:
- copy or distribute content
- use “Matchavia” brand or logo
- present content as own
11.3 Violations may result in legal claims.
XII. Final Provisions
12.1 Seller may amend the GTC.
12.2 Consumer relationships are governed by Civil Code and Consumer Protection Act.
12.3 GTC form part of complaint policy and privacy policy.
12.4 GTC become effective upon publication.
